Welcome to ByteMentor AI. These Terms of Service ("Terms") govern your access to and use of our AI-powered programming learning platform at bytementor.ai. By accessing or using ByteMentor AI, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our platform.

1. Acceptance of Terms

By creating an account, signing in through GitHub, Google, or accessing any feature as a guest, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. These Terms constitute a legally binding agreement between you and ByteMentor AI. We reserve the right to update, modify, or replace these Terms at any time, at our sole discretion, without prior notice. Changes take effect immediately upon posting. It is your responsibility to review these Terms periodically. Your continued use of the platform after any changes constitutes acceptance of the updated Terms.

2. Account Responsibilities

When you create an account on ByteMentor AI, you agree to:

• Provide accurate and complete information during registration.
• Maintain the security of your account credentials and not share your access with others.
• Be responsible for all activities that occur under your account.
• Notify us immediately if you suspect any unauthorized use of your account.
• Not create multiple accounts to circumvent any restrictions or limitations.

3. Subscription Plans and Billing

ByteMentor AI uses a credit-based model. Every paid and free plan gets a daily credit budget, and each AI tool deducts credits based on its compute cost. Current tiers:

• Free: 20 credits per day. Access to all 19 practice tools. No credit card required.
• Pro ($15/month or $120/year): 120 credits per day, 8,000-token responses, interview simulation (AI-graded). Billed monthly or yearly through Dodo Payments.
• Ultra ($29/month or $228/year): 250 credits per day, 12,000-token responses, priority interview quota, early access to new tools.

Pro and Ultra subscriptions auto-renew at the end of each billing cycle. You can cancel at any time from your account page; cancellation takes effect at the end of the current billing period. We reserve the right to change pricing with reasonable notice. Price changes do not affect your current billing cycle. No refunds are provided for partial billing periods.

4. Credits and Usage

Each ByteMentor account receives a daily credit allotment based on the active subscription tier. Individual tools deduct credits atomically at the moment of use. The following rules apply to all plans:

• Credits reset every day at 00:00 UTC.
• Credits are non-transferable between accounts.
• Unused credits do not roll over to the next day.
• Credits have no monetary value and are not refundable.
• Guests (visitors without an account) are entitled to one free try per practice tool, tracked by a privacy-preserving server-side fingerprint. See our Privacy Policy for details.
• We reserve the right to adjust per-tool credit costs. Material changes will be announced via an in-product banner at least seven days in advance.
• Subscription cancellation takes effect at the end of the current billing period. Credits remain available at your paid tier until the period ends.

5. Data Retention

Your data is retained permanently while your account is active. This includes chat history, practice sessions, evaluations, code submissions, skill mastery records, study plans, and all other learning data. When you delete your account, all associated data is permanently removed. For full details, see our Data Policy.

6. Acceptable Use

You agree to use ByteMentor AI only for lawful purposes. You agree not to:

• Abuse, harass, or harm other users of the platform.
• Attempt to reverse engineer, decompile, or extract the underlying AI models, prompts, or algorithms.
• Use the platform to generate malicious code, malware, or exploit code intended to harm systems or individuals.
• Circumvent, disable, or interfere with any security or rate-limiting features.
• Use automated tools, bots, or scrapers to access the platform beyond reasonable usage.
• Submit content that is illegal, offensive, or infringes on intellectual property rights of others.
• Resell, redistribute, or sublicense access to ByteMentor AI without our written consent.
• Use the platform to violate any applicable law or regulation.

7. AI-Generated Content Disclaimer

ByteMentor AI uses artificial intelligence models from Anthropic, OpenAI, and Google AI to provide tutoring, code analysis, evaluations, problem generation, and other educational content. You acknowledge and agree that:

• AI-generated content is provided for educational and informational purposes only and does not constitute professional advice.
• AI outputs may contain inaccuracies, errors, or incomplete information. Always verify AI-generated code before using it in production.
• AI-generated evaluations, scores, and skill assessments are approximate and should not be treated as definitive measures of your ability.
• We do not guarantee the accuracy, reliability, or completeness of any AI-generated content.
• Code execution occurs in sandboxed environments supporting JavaScript, TypeScript, Python, Java, C, and C++. We are not responsible for any issues arising from code you execute.

8. Intellectual Property

• Your Code: You retain full ownership of any original code you write and submit. By submitting code, you grant us a limited license to process it through our AI services solely for providing feedback and evaluations.
• AI-Generated Outputs: AI-generated code, explanations, and feedback are provided "as-is." You may use them freely, but we make no claims of ownership or warranties regarding their originality or fitness for any purpose.
• Platform Content: The ByteMentor AI platform, including its design, features, curriculum, lesson structures, adaptive algorithms, and branding, is our intellectual property and is protected by applicable laws.

9. Service Availability

ByteMentor AI is provided on an "as available" basis. We strive to maintain high availability but do not guarantee uninterrupted or error-free access. We may temporarily suspend or restrict access for maintenance, updates, or due to circumstances beyond our control, including outages at our AI provider partners. We do not offer any service level agreement (SLA) and shall not be liable for any downtime or service interruptions.

10. Limitation of Liability

To the maximum extent permitted by applicable law, ByteMentor AI and its creators, contributors, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, or goodwill, arising out of or related to your use of the platform. In no event shall our total liability exceed the amount you have paid us, if any, in the twelve (12) months preceding the claim.

11. Termination

We reserve the right to suspend or terminate your account at our sole discretion, with or without notice, for any reason, including violation of these Terms. You may terminate your account at any time by contacting us. Upon termination, your right to access the platform ceases immediately. Provisions that by their nature should survive termination (such as limitations of liability, intellectual property clauses, and data retention provisions) will remain in effect.

12. Modifications to Terms

We reserve the right to modify, update, or replace these Terms at any time, at our sole discretion, without prior notice or obligation to inform you directly. Changes take effect immediately upon posting to this page. The "Last updated" date at the top indicates when the latest revision was made. It is your sole responsibility to review these Terms periodically. Your continued use of ByteMentor AI after any modifications constitutes your acceptance of the revised Terms. If you do not agree with the updated Terms, you must discontinue use of the platform.
